Eine Presseinformation des Augustin
F13 am Freitag, den dreizehnten Jänner: Fasching von unten
Das Kürzel F13 steht für eine noch junge Zusammenarbeit von
künstlerischen und sozialen Initiativen, die versuchen, an der
"Unglücks"-Bedeutung des Datums Freitag der Dreizehnte mit Ironie
zu rütteln und einen neuen urbanen Volksbrauch zu entwickeln.
Solche Tage - der Kalender bietet uns heuer zwei "schwarze
Freitage" - sollen zu Feiertagen für Menschen, die sonst wenig zu
feiern haben, erklärt werden. Mit karnevalesken Mitteln soll
dabei auch auf die versteckte Armut und die Verdrängungen von
Randgruppen aus dem öffentlichen Raum aufmerksam gemacht werden.
Auf Initiative des Augustin finden diese "F13"-Tage bereits seit
dem Jahr 2002 statt. Diesmal, am 13. Jänner 2006, erhoffen sich
die Initiatoren größere Resonanz in der Öffentlichkeit:
"Wien wird an diesem Tag einen Faschingsumzug erleben, der an die
Epochen des verrückten, chaotischen Volksfaschings erinnert, bei
dem sich die Bettler zu Königen erklärten und sich von den
offiziellen Königen nichts sagen ließen. Als ErbInnen des
ungezähmten Fasching sammeln sich AugustinverkäuferInnen,
Sozialinitiativen, PerformancekünstlerInnen, MusikantInnen u.a.
kritisches Volk am Margaretenplatz und ziehen dann quer durch die
Stadt zum Spittelberg, wo - wenn schon nicht die
gesellschaftlichen Verhältnisse, so doch - die
Faschingsgesellschaft zum Tanzen gebracht wird", kündigt
Augustin-Sprecherin Angela Traußnig an.
Neben dem Faschingsumzug wird es kleinere Aktionen an
verschiedenen Punkten der Stadt geben, etwa einen "Kost-nix-
Laden" vor dem Arbeitsamt im 5. Bezirk oder ein Projekt des
Musikers Stefan Sterzinger (koopkitsch), das sich "vocalguerilla"
nennt.
Der F13-Tag wird mit einem Fest im Amerlinghaus abgeschlossen,
bei dem nach den Chören "Stimmgewitter Augustin" und
"Gegenstimmen" Krispel und Molden als "Red River Two" zu hören
sind. Der Eintritt ist frei. Im Rahmen des Festes wird der
Bürobetrieb der "Ersten Österreichischen Absageagentur", eine
Initiative Peter A. Krobaths nach Berliner Vorbild, aufgenommen
werden. Die alltägliche Praxis vieler Arbeitssuchender soll damit
umgekehrt werden, denn: "Selbst absagen ist besser fürs Ego als
eine Absage erhalten", erklärt der Initiator.
Wir ersuchen Sie, F13 in Ihrer Berichterstattung zu
berücksichtigen und würden uns freuen, Sie beim Umzug oder beim
Fest begrüßen zu dürfen.

Der neue Irak zwischen Wahlen und Terrorismus
Während der Irak im Laufe des Jahres 2005 mit der neuen
Verfassung und den erfolgreich durchgeführten Wahlen Fortschritte
beim Aufbau neuer demokratischer staatlicher Strukturen erreichen
konnte, ist die Sicherheitslage und das Alltagsleben vor Ort
immer noch in weiten Teilen des Landes katastrophal.
Nach wie vor sind große Gebiete des Zentraliraks nicht unter
Kontrolle der Regierung. Im Nord- und Zentralirak regieren zwar
Parteien der irakischen Regierung, allerdings ist das Land
weiterhin ethnisch- und religiös fragmentiert.
Die Institutionenbildung des neuen Irak steht damit immer noch am
Anfang. Über Fehlschäge und Erfolge dieses Aufbaus eines neuen
Irak diskutieren Vertreter der wichtigsten Parteien des Irak:

Bezirksgericht Neusiedl gegen Stiefkind-Adoption
RKL: "Nun ist das Landesgericht Eisenstadt am Wort"
Nach den Erfolgen im Steuerrecht und bei der Mitversicherung in
der Krankenversicherung geht die RKL-Klagsoffensive zur
Gleichstellung gleichgeschlechtlicher Paare in die nächste Runde.
Das Bezirksgericht Neusiedl hat einer Frau die Genehmigung der
Adoption des Kindes ihrer Lebensgefährtin verweigert. Nun hat das
Landesgericht Eisenstadt über den Fall zu entscheiden.
Theoretisch können auch gleichgeschlechtlich l(i)ebende Menschen
als Einzelpersonen Kinder adoptieren, auch die leiblichen Kinder
ihrer PartnerInnen (Stiefkindadoption). Faktisch ist dies aber
nicht (sinnvoll) möglich, weil die leibliche Mutter ihre
elterlichen Rechte verliert, wenn ihre Partnerin ihr Kind
adoptiert bzw. der leibliche Vater seine elterlichen Rechte wenn
sein Partner sein Kind adoptiert. Heterosexuelle (auch
unverheiratete) Paare können nach Adoption des Kindes des einen
Partners durch den Stiefelternteil beide rechtlich Eltern sein.
Gleichgeschlechtlichen Paaren ist dies, und damit eine sinnvolle
Stiefkindadoption, verwehrt.
Das RKL unterstützt den Fall einer Frau, die die Adoption des
Kindes ihrer Partnerin bereits vertraglich besiegelt hat, den
Adoptionsvertrag aber nicht zur gerichtlichen Genehmigung
einreichen konnte, weil das nach der geltenden Gesetzeslage
zwangsläufig den Verlust der elterlichen Rechte durch die Mutter
zur Folge hätte. Mit einem Individualantrag an den
Verfassungsgerichtshof wurde die Aufhebung der entsprechenden
Bestimmung des Allgemeinen Bürgerlichen Gesetzbuches (§ 182 Abs.
2 Satz 2 ABGB) begehrt. Der Verfassungsgerichtshof hat die
Antragstellerin an das Pflegschaftsgericht verwiesen. Nach
Ablehnung ihres Antrags durch das Bezirksgericht könne dann das
Landesgericht bei ihm, dem Verfassungsgerichtshof, die Aufhebung
des Gesetzes beantragen (VfGH 14.06.2005, G 23/05).
Freibrief zur Diskriminierung?
Das Bezirksgericht Neusiedl am See hat die Genehmigung des
Adoptionsvertrages mit Beschluss vom 10.10.2005 (1 P 101/05g)
verweigert. Fragen sexueller Orientierung fallen in den
Schutzbereich des Rechtes auf Privat- und Familienleben (Art. 8
EMRK) und Diskriminierungen auf Grund der sexuellen Orientierung
sind grundsätzlich nicht zu tolerieren, so der Richter. Dessen
ungeachtet vermeinte er unter Berufung auf das Urteil des
Europäischen Menschenrechtsgerichtshofs im Fall Fretté gg.
Frankreich 2002, dass im Bereich des Adoptionsrechts den Staaten
ein weiter Ermessensspielraum zustehe, der die Benachteiligung
homosexueller Paare bei der Stiefkindadoption decke.
Die Adoptionswerberin, ihre Partnerin und das Kind haben gegen
diesen Beschluss Rekurs erhoben und darauf hingewiesen, dass es
in ihrem Fall nicht wie im Fall Fretté um die Einzeladoption
eines fremden Kindes geht, zu dem noch keinerlei Beziehung
besteht, sondern um die Benachteiligung von unverheirateten
homosexuellen Paaren gegenüber unverheirateten heterosexuellen
Paaren (die der Europäischen Menschenrechtsgerichtshof ein Jahr
nach Fretté prinzipiell für unzulässig erklärt hat: Karner gg.
Österreich 2003) bei der Stiefkindadoption.
"Der Ball liegt nun beim Landesgericht Eisenstadt", sagt der
Wiener Rechtsanwalt Dr. Helmut Graupner, Präsident der
Homosexuellen-Bürgerrechtsorganisation Rechtskomitee LAMBDA und
Anwalt der Familie, "und wir dürfen gespannt darauf sein, ob es
der Einladung des Verfassungsgerichtshofs folgt und, so wie
seinerzeit das Oberlandesgericht Innsbruck hinsichtlich § 209, im
Sinne der Grund- und Menschenrechte die Aufhebung eines
homosexuellendiskriminierenden Gesetzes beantragt".
Das 1991 gegründete Rechtskomitee LAMBDA (RKL) arbeitet
überparteilich und überkonfessionell für die umfassende
Verwirklichung der Menschen- und Bürgerrechte
gleichgeschlechtlich l(i)ebender Frauen und Männer. In seinem

Menschenrechtsexperten Dr. Lilian Hofmeister und Univ.-Prof. Dr.

RKL-Litigation Offensive Continues
District Court of Neusiedl Refuses Stepparent-Adoption
RKL: "Now it's the turn of the Regional Court of Eisenstadt"
After the great successes gained in tax law and regarding health
insurance partner benefits RKL-litigation offensive for same-sex
partners' rights goes into its next round. The District Court of
Neusiedl refused to approve the adoption of a minor child by the
same-sex partner of her mother. Upon appeal the case is now
pending before the Regional Court of Eisenstadt.
Theoretically according to Austrian law also homosexuals can, as
individuals, adopt a child (single adoption), also the
(biological) children of their partners (stepparent-adoption). In
fact this however is not practically possible, since the
biological mother looses her parental rights, when her partner
adopts her child; vice versa the biological father looses his
parental rights, when his partner adopts his child. On the
contrary heterosexual couples (also if unmarried) can be both
legal parents after adoption of a child of one of the partners by
the step-parent. The law withholds this possibility, and
therefore a meaningful and practical step-parent adoption, from
same-sex partners.
RKL supports the case of a woman, who entered into an adoption
contract with her partner concerning the adoption of her child.
The woman however could not ask the Court for approval of this
contract since such an approval would have meant that the
biological mother, her partner, would loose all her parental
rights. So the women and the child asked the Constitutional Court
to repeal the respective statutory provision (Art. 182 par. 2 2nd
sentence General Civil Code, ABGB). The Constitutional Court
referred the applicants to the family court. After this court
refuses approval of the adoption the applicants could then ask
the Appeals Court to address the Constitutional Court for repeal
of the provision (VfGH 14.06.2005, G 23/05).
License to discriminate?
The applicants did so and the family court, the District Court of
Neusiedl am See, refused approval by decision of 10th October
2005 (1 P 101/05g). Sexual orientation, the judge said, is a
protected category under the right to private and family life
(Art. 8 ECHR) and discrimination on the basis of sexual
orientation as a principle is intolerable. Nevertheless the judge
(referring to the judgment of the European Court of Human Rights
in Fretté vs. France 2002) held the opinion that in the area of
adoption states would enjoy a wide margin of appreciation, which
margin would allow disadvantaging of same-sex couples in
stepparent-adoption.
The two partners and her child appealed this decision and pointed
out that their case, unlike Fretté 2002, is not about single
adoption of a foreign child, to which there is no relation yet
established at all, but that their case is about unequal
treatment of unmarried same-sex couples in relation to unmarried
opposite-sex couples (such unequal treatment having been declared
inadmissible by the Court one year after Fretté in Karner vs.
Austria 2003) regarding stepparent-adoption.
"Now it's the turn of the Regional Court of Eisenstadt”, says Dr.

family, "We are anxious to see if it will follow the invitation
of the Constitutional Court and, as the Upper Regional Court of
Innsbruck did regarding infamous Art. 209, will on the basis of
human rights apply for the repeal of legislation discriminatory
to same-sex couples.”

and denominational level is working for the implementation of
human rights for homo- and bisexual men and women. In its
honorary board it convenes so prominent members as the Chairman

| Netbase zieht nach Neupositionierung erfolgreiche Bilanz!

"In Wien herrscht großer Bedarf an kritischer Auseinandersetzung
mit Kunst, Kultur und Gesellschaft im Informationszeitalter!" Die
Wiener Medienkultur-Institution Netbase zieht nach dem Neustart
Mitte September 2005 eine erste Bilanz und sieht sich nach dem
Erfolg bestätigt. Über zwanzig Veranstaltungen in den neuen
Räumlichkeiten sowie Beiträge im Community TV und internationale
Publikationen haben für eine neuerliche Ausweitung der
Zielgruppen gesorgt und den künstlerischen und global vernetzten
Austausch intensiviert. Den Höhepunkt bildete im November das
World-Information City Festival im indischen Bangalore, das auch
in Wien durch Vermittlungsaktivitäten begleitet wurde.
"Wir haben mit der Neuausrichtung den Anspruch verfolgt, Netbase
noch stärker als internationalen Knotenpunkt zu positionieren",
erklärt Netbase-Leiter Konrad Becker. "Mit der Schwerpunktsetzung
auf Kontrollgesellschaft, Geistiges Eigentum und die Gefahr der
zunmehmenden Zungangsbeschränkungen zu Information, Wissen und
Bildung haben wir diskursiven Öffentlichkeiten einen offenen Raum
geschaffen, der auch in Wien dringend nötig ist." Viele
Künstlerinnen und Künstler sowie Persönlichkeiten aus den
Bereichen Medien, Theorie und Wissenschaft erklärten sich in den
Wochen nach dem Neustart bereit, mit Projekten und Präsentationen
zum Angebot der Netbase beizutragen.
Das Jahr 2006 bietet die Möglichkeit zur weiteren Etablierung des
Medienkultur-Sektors in Wien. Mit Netbase verfügt die Stadt über
eine Schnittstelle von Kunst und Kultur zu neuen
Informationstechnologien, die als Partner in vielen
internationalen Kooperationsprojekten großes Ansehen genießt.
"Nicht zuletzt deshalb, vor allem aber auch angesichts der
erfolgreichen Eröffnungsaktivitäten, sind wir zuversichtlich,
dass die Kulturpolitik diesem Stellenwert in der Finanzierung
Rechnung tragen wird", so Becker abschließend.

G8/Genua: Wichtiges Prozess-Update
In einer überraschenden Wendung verabschiedeten die
Christdemokraten im Dezember eine Änderung am "Save
Previti"-Gesetz das alle Verfahren von dieser Verordnung befreit.
"Save Previti" ist eine von Silvio Berlusconi eingebrachte
Änderung im Strafrecht, welche die Zeitspanne für Strafverfahren
nahezu halbiert und somit viele lang andauernde Gerichtsverfahren
quasi zwangsbeendet ohne das es zu einem Richterspruch kommt.
Dies bedeutet, das die grad stattfindenden Diaz- und Bolzaneto-
Verfahren nicht mehr vom "Save Previti Gesetz" betroffen sind. In
beide Verfahren wurde nun die Verjährungsfrist wieder auf 15
Jahre gesetzt.
Mark Covell, einer der am schwersten verletzten und Indymedia UK
NUJ Journalist sagt dazu: "Ich freue mich sehr und bin
überglücklich. Ich bin sicher das die restlichen Diaz-Opfer
ebenso denken. Beide Verfahren werden nun zu Ende gebracht werden
können und wir werden Gerechtigkeit bekommen, in dem diese
hochrangigen Polizisten für ihre Verbrechen ins Gefängnis gehen.
Ich stehe in Kontakt mit Supporto Legale die das größte Diaz und
Bolzaneto Opfertreffen in Berlin haben. Die Deutschen sind sehr
glücklich.". Nach Ankunft in Genua sagte er ebenfalls, "Einige
der britischen Zeugen und ich sagen diesen Monat vor Gericht aus
und Videomaterial von Undercurrents vom Beginn der Razzia wurde
eingereicht und wird am 11. Januar in einer öffentlichen
Gerichtssitzung abgespielt. Dies ist ein großer Tag für alle von
uns."
In einer weiteren Entwicklung wird durch Anwälte, Friedenrichter
und Richter am 17., 18. und 19. Januar möglicherweise ein Schlag
gegen das "Save Previti"-Gesetz erfolgen. Es wird immer
deutlicher das Berlusconi isoliert und völlig alleine steht in
dem Versuch diesen Gesetzesentwurf zu verabschieden um sich
selbst vor Verfahren gegen ihn zu schützen. Gianfranco Fini hat
sich ebenfalls entschlossen Opposition gegen diesen
Gesetzesentwurf zu beziehen, da eine Zurückweisung dieses
Entwurfes durch das Parlament zur Folge haben würde, das
Berlusconi aus den Wahlen am 9. April fliegt.
Die Diaz- und Bolzaneto-Verfahren, auch wenn nicht frühestens vor

haben festgehalten, dass Gianfranco Fini und Berlusconi keine
glaubhaften Taktiken bzgl. Verbrechen, Anti-Terrorismus und Recht
und Ordnung haben, aufgrund der hohen Zahl (75) von
Polizeibeamten vor Gericht in diesem G8-Prozess. Beide Verfahren
ziehen weiterhin eine hohes internationale Medieninteresse auf
sich und dies wird sich mit Näherrücken der Wahlen noch
verstärken, aufgrund von weiteren zu erwarteten Enthüllungen in
den nächsten Wochen.
Der Druck für einen Rücktritt von Justizminister Castelli wird
ebenfalls wachsen, aufgrund von Anschuldigungen das er
verantwortlich für die Bedingungen in Bolzaneto nach der Diaz-
Razzia war. Auch werden sich Forderungen nach einer
parlamentarischen Untersuchgsausschuss zur Rolle von diversen
Politikern im Diaz-Massaker und anschließenden Folterungen nach
dem G8-Treffen im Juli 2001 verstärken. Romano Prodi und
Bertinotti haben eine solche Untersuchung in ihrem Wahlprogramm
bereits festgeschrieben.

Greetings from New Jersey, where Monday the NJ Assembly is
expected to vote to create a death penalty study commission and
to enact a moratorium on executions in that state. The bill
passed in the Senate last month and Gov. Codey has said he will
sign it if it reaches his desk. If it passes, this will be the
first moratorium imposed by a legislature in the U.S. I'm
looking forward to witnessing the vote, and I hope you will join

here to be a part of the on-site crew. It's been a great

moratorium bill will be heard.

NEW PRIMETIME TV SHOW - "INJUSTICE"

Tonight (Friday) at 8 pm central time/ 9 pm eastern time ABC's
new show called "In Justice" aired. I don't normally watch TV
but thought I'd watch this to see if it was going to be any
good. The premise is on people who have been wrongly convicted.
I thought they did a very good job. This show will air on
Fridays - probably as long as there is a decent audience. If it
takes off, maybe it will let the general public (the sleepers)
know that innocent people do in fact get convicted. Maybe that
will make it a little easier for the innocent ones to have their
cases heard based on the merits rather than simply being
dismissed based on procedural bars without ever looking at the
merits of their cases. At least that is my hope.

The International Committee Against Stoning demands the leaders
of Islamic Republic of Iran to be prosecuted for their crimes
against humanity.
The Government of the Islamic Republic of Iran is the leading
regime in the world in stoning women and men to death for sexual
relationship outside marriage and for homosexuality.
In the past 26 years, hundreds of people have been murdered in
this barbaric fashion in Iran. Because of both national and
international pressure, at the end of 2002 the Islamic government
backed off and announced that it will not issue any more stoning
verdicts; but contrary to its promise, it has passed one stoning
sentence after another throughout 2005.
Four death by stoning sentences were passed just in December
2005. However, so far, with the help of international campaigns,
opposition and pressure, we have succeeded in preventing these
executions.
The International Committee Against Stoning is an active
worldwide organization that strongly opposes stoning and wants to
bring the members of the Islamic regime who are responsible for
these acts in the past 26 years to justice in an international
tribunal.
On behalf of two hundred international human rights organizations
and societies and their members, as well as millions, who have
supported our campaigns and resolutions, we request an immediate
investigation, through an international court, into the stoning
of hundreds of victims in the past 26 years by the Islamic
Republic of Iran.
In 2006, our main focus will be on bringing this gross violation
of human rights to the attention of the world, exposing the
barbaric actions of the Islamic Republic of Iran, and taking
appropriate steps to stop these acts.

2005 overview. I hesitate only briefly before pointing out
DPIC's emphasis on the *fact* that offering an alternative to the
death penalty is a sound strategy that is working. I note that
CUADP is the *only* national organization *for* ALTERNATIVES to
the Death Penalty,

Alternatives to the Death Penalty - see www.uuadp.org - thanks
Nancy and Marj for reminding me!)
and further, CUADP is the *only* organization that actually has a
statement proposing viable alternatives to the death penalty.

planning (and implementation) committee.

execution in the US in the post-Furman (1972) death penalty era.
